This is a research paper on shaming in specialized drug courts. This study showed that the recidivism is higher for the specialized drug court then for the regular processing. This study reveals that the drug court is more stigmatizing then the ordinary court; in addition it is not reintegrative enough.
Miethe et al. (2000) explore the reintegrating shaming theory; using it as a framework they study the effectiveness of specialized drug courts in reducing recidivism risks. This study showed that the recidivism is higher for the specialized drug court then for the regular processing. This study reveals that the drug court is more stigmatizing then the ordinary court; in addition it is not reintegrative enough.
The expectation of a positive effect of drug court was anticipated keeping in mind the reintegrative role of the judge and the family in form of counseling and therapy. The samples were taken in Clark County Las Vegas Nevada. The sample size was of 301 defendants who were observed in the courtroom for 3 months. The results showed that recidivism was 10% higher than normal for those going through special drug courts then for others. Recidivism was also higher for drug charges and non-drug charges.
The surprising results show that the process and the structure of the drug court is much different from the theoretical framework, and they are more stigmatizing then reintegrating.
